At JuvYou™ we care about your privacy and the trust you place in us by providing your Personal Information and we want to be transparent about how we use it and how we protect it.

This Privacy Notice (together with the JuvYou Terms of Service, which can be accessed at the Legal - JuvYou Terms of Service section of the JuvYou Mobile App), describes how we collect, use, and share your personal information and the measures we take to keep it safe. It tells you about the privacy practices for the JuvYou Mobile App and services (the “JuvYou Services”), your rights and choices with respect to your personal information, and how you can contact us if you have any questions or concerns.

This Privacy Notice applies anytime you connect with us –using our application, by social media pages, or contacting us by phone, email, mail, or chat.

Read this Privacy Notice carefully. If you do not consent to the terms of the Privacy Notice, please do not access or use the Services that JuvYou™ and its affiliates (collectively, “JuvYou™,” “we,” “us,” or “our”) provide.

Please note that the JuvYou™ Mobile App is designed and marketed to be limited in territorial and personal data processing scope to the United States and its residents. Should you be a resident of the EEA (for these purposes, member countries of the European Union and countries of Iceland, Liechtenstein, and Norway and, to the extent applicable, Switzerland), the United Kingdom, or any other country, please note that the United States may have privacy and data protection laws that differ from, and are potentially less protective than, the laws of your country. If you are a non-US resident, and you have access to the JuvYou™ App, you agree to this risk when you create a JuvYou™ account and click “Create account” to become a registered user, or “Continue” as a Guest user.” If you later wish to withdraw your consent, you can delete your JuvYou™ account as described in the Your Rights and Choice to Control Your Personal Data section.

When you use our Services, we collect the following types of information.

Information You Chose to Provide

NOTE: It is not standard JuvYou practice to verify the provided personal data or the validity thereof. The person providing the data, user or contracting party is solely responsible for the accuracy of the provided data. When providing an email address, all users assume responsibility that they are the exclusive user of the provided email address. For this reason, any liability for logins related to an email address shall be borne exclusively by the user who provided the email address.

To personalize your plan and improve the accuracy of the Services, you may decide to provide us with additional personal data either directly entering data or connecting with other Apps like your Apple Health, Fitbit, Keto-Mojo, or services provided by your Health Care Professional / Care Team. Health Information from your Health Care Professional / Care Team is never stored in the App, it is only referenced via API, meaning that disconnecting will remove any reference to this data in the App.

Ethnicity data

Ethnicity

To personalize your plan and improve the accuracy of the Services, you may decide to provide us with additional personal data.

Food consumption habits

Food frequency, food avoidances, eating style/patterns

To personalize your plan and improve the accuracy of the Services, you may decide to provide us with additional personal data.

Additional information

Photos, message, reviews, feedback

You may choose to provide us with additional information, like messages on social media discussion boards and third-party platforms (e.g., Twitter), by accessing our social networking accounts.

Statistical or demographic data.

NOTE: Aggregated data is derived from your Personal Information but is not Personal Information as this data will not directly or indirectly reveal your identity.

When your device accesses us services, data relating to your device is transferred from your device to our servers.

Information We Receive from Third Parties

If you choose to connect your account on our Services to your account on another service, we may receive information from the other service. For example, if you connect to Apple Health Kit, Fitbit, KetoMojo or services provided by your Health Care Professional / Care Team. You can stop sharing the information from the other services with us at any time by removing our access to that other service using the Settings on your device.


3. How We Use Information

Provide and Maintain Services

Using the information, we collect; we are able to deliver the Services to you and honour our Terms of Service contract with you. For example, we need to use your information to provide you with accurate JuvBand information and Recommendations, or to give you customer support.

Improve and Personalize the Services

We use the information we collect to improve and personalize the Services and to develop new ones. For example, we use the information to troubleshoot and protect against errors; perform data analysis and testing; conduct research; and develop new features and Services.

We also use your information to make extrapolations and show you more relevant recommendations and improve the accuracy of your JuvBand.

To provide you with the best possible user experience and ensure our information is accurate, we may combine the information you share with us and that which we receive when you connect our App with third-party data e.g., Keto-Mojo. Examples may include Ketone levels, sleep patterns, step counts, and other information from JuvYou Data partners.

Communicate with You

We use your information when needed to send you Service notifications and respond to you when you contact us, to promote new features, options, and media content that we think you would be interested in. You can control marketing communications and most Service notifications by using your notification preferences in My Account Settings or opt out via the “Unsubscribe” link in an email.

Promote Security and Safety

We use the information we collect to promote the safety and security of the Services, our users, and other parties. For example, we may use the information to authenticate users, protect against fraud and abuse, respond to a legal request or claim, conduct audits, and enforce our terms and policies.

Aggregated Data

We also collect, use, and share aggregated data such as statistical or aggregated health data for our purposes. For example, we may aggregate data about your use of the JuvYou App and calculate the percentage of users accessing a specific feature. However, if we combine or connect aggregated data with your personal information so that it can directly or indirectly identify you, we will treat the combined data as personal information which will be used in accordance with this Notice.

We may use aggregated data to conduct research on the efficacy of our Service and to identify where we can improve our product, or to provide anonymized reports to analyse the usage, uptake and efficacy of the products and services to JuvYou partners.


4. Sharing Your Information

We do not share your personal information except in the limited circumstances described below.

Service Providers

We may transfer your personal information to companies and individuals that provide services on our behalf or help us operate our Services or our business (such as customer support, name, and address verification; fraud protection; email distribution; information technology, sales, marketing, push notifications, data analysis, and research).

Affiliates

We may share your personal information with our corporate parent, subsidiaries, and affiliates for purposes consistent with this privacy policy.

User-Generated Content

If you share user-generated content, that information may be made available publicly. For example, your photos, videos, stories, posts, comments, product reviews, product questions and answers, wish lists, and any other content or information you choose to provide will be shared with users of the JuvYou platform or the platform used to share the content. See User-Generated Content Submission Terms Section for detailed conditions of sharing user-generated content.

Advertising and Marketing

We share certain data elements like email addresses with third parties in connection with advertising, retargeting or analytics on behalf of JuvYou.

Legally Required

We may be required to disclose personal information pursuant to lawful requests, such as subpoenas, law enforcement investigations, or court orders, or in compliance with applicable laws. We also may release information to protect our rights, or other interests, including those of our customers or other third parties or to prevent illegal activities or violations of Terms of Service. This may include sharing information with other companies, lawyers, agents, or government agencies.

Business Transfers

If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of service to another provider (collectively a “Transaction”), your personal information and other information may be shared in the diligence process with counterparties and others assisting with the Transaction and transferred to a successor or affiliate after the Transaction.

Aggregated or De-Identified Information

We may share non-personal information that is aggregated or de-identified so that it cannot reasonably be used to identify an individual. We may disclose such information to third parties, for example, in reports about health data or physical activity patterns, to partners under agreement with us, whitelist this information for clinical research purposes.

Links

The JuvYou Mobile App may contain links to applications not operated or controlled by JuvYou. We are not responsible for the privacy practices of other services. Please refer to those services’ privacy policies for information about how they collect and process your personal information.

Where you authorise the transfer to your Health Care Provider / Care Team

If you choose to connect your account on our Services to your account or services provided by your Health Care Professional / Care Team, we may transfer your personal information to your Health Care Professional / Care Team. You can stop sharing the information from the other services with us at any time by removing our access to that other service using the Settings on your device.


5. Advertising and Analytics Services Provided by Others

JuvYou collaborates with partners who provide us with analytics and marketing services, collecting information about your visits to the JuvYou Mobile App and share advertisements for content or products that you may be interested in. These targeted advertisements may appear on other sites that you visit. These providers may combine the information we share with information already in their possession and offer you choices about which ads you receive. This information is collected using a cookie or other tracking technologies used by most apps. These third parties have privacy policies of their own that apply to your use of their platforms.


6. Social Sharing Features

If you choose to contact or share content with JuvYou on social media platforms, we may contact you via direct message or use other social media tools to interact with you. In these instances, your interactions with us are governed by this Privacy Notice as well as the privacy notice of the social media platform you use.


7. Your Rights and Choices to Control Your Personal Data

Accessing and Exporting Your Information: By logging into your Account Settings, you can access most of your personal data. You can also contact us via care@juvlabs.com to confirm whether we are processing your personal information and if so, provide you with your personal information in a structured, commonly used, and machine-readable format. To protect your privacy, we will confirm your identity before updating or exporting your information. If you require additional copies, we may need to charge a reasonable fee.

Updating Your Information: By logging into your account and using your Account Settings, you can change and update your personal information, or you can also contact us.

Deleting Your Information: By logging into your account and using your account settings, you can delete your account if you wish. If you choose to delete your account, email us the request at the email or actual postal address in the How to Contact Us section to delete or where deletion isn’t technically available, to anonymize your data. JuvYou makes our best effort to delete or encode all personal data and identifiers associated with your account. Please note that we may preserve data for legal reasons or to prevent harm, including as described in the Sharing Your Information section.

Please note that when you contact us to exercise your right to be forgotten, your associated email and other contact information are removed from all JuvYou mailing lists.

Additional choices: Your account settings and tools allow you to control data use as described below. For example, through your notification settings, you can limit the notifications you receive from us; and under the JuvYou Mobile App settings, you can revoke the access of third-party applications that you previously connected to your JuvYou account.

JuvYou Emails including Direct Mailings

You may unsubscribe from our promotional emails using the link provided at the bottom of each email, or by Contact Us. Because emails are planned in advance, you may still receive mailings while we process your request.


8. Cookie Notice

JuvYou and some of our partners use cookies and similar technologies on the JuvYou Mobile App. Here we explain these technologies, why we use them, and the choices you have

Technologies We Use

Like many services, we use cookies, pixels, local storage, and software development kits (“SDKs”) to remember things about you so that we can provide you with a better experience.

Cookies are small data files stored on your browser or device. They may be served by the entity that operates the application or website you are visiting (“first-party cookies”) or by other companies (“third-party cookies”). For example, we partner with third-party analytics providers, like Google, which set cookies when you visit our websites. This helps us understand how you are using our Services so that we can improve them.

SDKs are blocks of code provided by our partners that may be installed in the JuvYou Mobile Apps. SDKs help us understand how you interact with the JuvYou Mobile Apps and collect certain information about the device and network you use to access the application. Performance:
These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our application, e.g., Google Analytics. They help us to know which sections are the most and least popular and how visitors navigate around the app. All information these cookies collect is aggregated and therefore anonymous.


Targeting:
These cookies may be set through our site by our advertising partners. They may be used by those companies to build a profile of your interests and show you relevant adverts on other sites. They do not store directly personal information but are based on uniquely identifying your browser and internet device. If you do not allow these cookies, e.g., Google Analytics, on your device settings, you will experience less targeted advertising.


Please note: The JuvYou App does not respond to “Do Not Track” signals because we do not track our users over time and across third-party websites to provide targeted advertising. However, we believe that you should have a choice regarding interest-based advertisements served by our partners, which is why we outline the options available to you below.


Your choices:
There are tools that allow you to choose how cookies and similar technologies are used throughout the app ecosystem based on the browser and device you are using:


      1. You may use your browser or device settings to clear or decline cookies.
        1. Check your mobile device for settings that control ads based on your interactions with the applications on your device. For example, on your iOS device, disable the “Allow Apps to Request to Track” setting, and on your Android device, enable the “Opt out of Ads Personalisation” setting.
        2. To prevent your data from being used by Google Analytics, you can install Google’s opt-out browser add-on.
        3. To opt out of ads on Google that are targeted to your interests, use your Google Ads settings.
        4. For information on how our advertising partners allow you to opt out of receiving ads based on your web browsing history, please visit http://optout.aboutads.info.

9. Privacy of Children

At JuvYou, we are committed to protecting the rights of children. Our application is not intended for users under the age of 18, and we do not knowingly collect personal information from children without the consent of the parent or guardian. Consistent with the Children's Online Privacy Protection Act (“COPPA”), the App are not intended for use by anyone under the age of 18 (COPPA's minimum protections are for minors 13 years of age or under). If we learn that personal information of a child has been collected without parental consent, then we will take the appropriate steps to delete this information. 10. Information Security

We follow generally accepted industry standards, including the use of reasonable administrative, physical, and technical safeguards, like encryption or hashing when receiving or transmitting your information.

However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee the security or confidentiality of your personal information. We also encourage you to practice general internet safety guidelines, such as choosing a strong and unique password for your JuvYou account, changing your password if you suspect it has been compromised, and signing out of your account when you are finished. Please note that JuvYou will never ask for your credit card information over email.


11. Nevada Residents

12. California Residents

If you are a California resident, please review the following additional privacy disclosures under the California Consumer Privacy Act of 2018 ("CCPA") provides you with additional rights. You are entitled to exercise these rights free from discrimination. Please note that CCPA may not apply to the JuvYou Services, depending on number of users and revenue generated.

Do not sell my information

We never sell the personal information of our users in the traditional sense. We do collaborate with partners who provide us with advertising services as described in the section. To learn more about how these partners collect data and your options for opting out of the sharing of your personal information for interest-based advertising, please read our Cookie Notice Section.

13. Privacy Notice Changes

We may change our Privacy Notice at any time. If we do, we will post the updated Privacy Notice on our website(s) and update the stated effective date of the Privacy Notice or otherwise notify you as required by applicable law, we will be providing a notice of material changes to privacy representations to registered users of the Mobile App. We encourage you to review this notice periodically.
